Note: इस – पत्र को पाच खण्डो – अ , ब , स , द , एवं इ में विभाजित किया गया है | खण्ड – अ ( लघु उतरीय प्रश्न है , जिसके दस भाग है | ये सभी दस भाग अनिबार्य है | खण्ड – ब , स , द , एवं इ ( विस्तृत उतरीय प्रश्न ) प्रत्येक में दो प्रश्न है | प्रत्येक खण्ड से एक प्रश्न कीजिए | विस्तृत उतर अपेक्षित है |

This is paper is divided into five Sections – A, B, C, D, & E Section – A ( Short Answer Questions ) contains one question of ten parts requiring short answer . all these ten parts one compulsory . Sections –B, C, D, & E (Descriptive Answer questions) each contains two questions. Attempt one question from each Section. Answer must be descriptive.

Section – A (खण्ड – अ)

इस खण्ड में एक प्रश्न के दस भागों के लघु उत्तर अपेक्षित है | प्रत्येक भाग 4 अंको का है |

1, Explain the following:

निम्नलिखित को स्पष्ट कीजिए:

(i) What is a voidable contract?

व्यर्थनीय अनुबन्ध क्या है?

(ii) When is a person competent to contract?

एक व्यक्ति करने के योग्य कब होता है?

(iii) Distinguish between bailment and pledge.

निक्षेप और गिरवी में अन्तर स्पष्ट कीजिए |

(iv) Who can be become an agent? Explain.

एक एजेंट कौन बन सकता है? व्याख्या कीजिए |

(v) Explain the meaning of contract of sale.

विक्रय अनुबन्ध का अर्थ स्पष्ट कीजिए |

(vi) When is condition to be treated as warranty?

शर्त को आश्वासन कब माना जाता है?

(vii) Explain bill of exchange.

विनिमय विपत्र की व्याख्या कीजिए |

(viii) What are the various types of consumer exploitation?

 

उपभोक्ता शोषण के विभिन्न तरीके कौन-कौन से है?

(ix) Explain the provisions in respect of authorized persons’ under FEMA.

फेमा के अन्तर्गत ‘अधिकृत व्यक्ति’ से सम्बन्धित नियम दीजिए |

(x) What is meant by negotiation?

परक्रामण से क्या आशय है ?

Section – B (खण्ड-ब)

2, Define the ‘Contract’. Explain essential elements of a valid contract.

‘अनुबन्ध’ शब्द की परिभाषा दीजिए | एक वैध अनुबन्ध के आवश्यक लक्षण बताइए |

Or/अथवा

3, What is a contract of guarantee? Under what circumstances a surety is discharged from his liability?

प्रतिभूति अनुबन्ध क्या है? किन परिस्थितियों में एक प्रतिभू अपने दायित्त्व से मुक्त हो जाता है |

Section – C (खण्ड – स)

4, “Nemo dat qouad non habet.” Explain this maxim and state the exceptions of the rule wmbodied in it.

“कोई भी व्यक्ति उस चीज को नहो दे सकता जो उसके पास नही है |” इस कथन की व्याख्या कीजिए और इस नियम के अपवादों का वर्णन कीजिए |

or/अथवा

5, Write short answers of the following:

(a) What is a void agreement?

(b) Accord and satisfaction.

(c) Explain sale by action.

निम्नलिखित के संक्षिप्त उत्तर लिखिए:

(a) व्यर्थ ठहराव किसे कहते है?

(b) आश्वान एवं संतुष्टि |

(c) नीलामी द्वारा विक्रय की व्याख्या कीजिए |

6, Define ‘Negotiable Instrument’ and discuss the legal presumptions of a negotiable instrument.

विनिमय साध्य लेखपत्र की परिभाषा दीजिए तथा एक विनिमय-साध्य लेखपत्र की वैधानिक मान्यताओं की विवेचना कीजिए |

or/अथवा

7, When a hegotiable instrument us considered as dishonoured? What are its effects? What are the duties of holder upon such dishonour?

एक विनिमय साध्य लेखपत्र कब अनादरित माना जाता है? इसके क्या प्रभाव होते है? इस सम्बन्ध में धारक के कर्तव्यों का वर्णन कीजिए |

Section – E (खण्ड – इ)

8, Who is a consumer? What are his rights under consumer protection act?

एक उपभोक्ता कौन है? उपभोक्ता सरंक्षण अधिनियम के अन्तर्गत उसके क्या अधिकार है?

Or/अथवा

9, What is foreign exchange management act, 2000? Explain its objectives and main provisions.

विदेशी विनिमय प्रबन्धन अधिनियम, 20000 क्या है? इसके उदेश्यों एवं प्रमुख प्रावधानों को बताइए |
